(a) Beth is forced to try and find a second job because her
partner, John, has been severely injured in a road traffic
accident. She needs a larger income to help make ends meet. Finally
she gets a job operating a bulldozer on a construction site. On her
first day at the job she destroys a small hut used by other
construction workers to eat and sleep. In her mistaken manoeuvre
she also severely injures herself and two fellow workers. She
claims that her employer, Evan, is liable because the hut and the
workers should never have been located that close to the
construction site and as a consequence he has failed to provide a
safe system of work. Advise Evan in tort law.
