Fred and Barney have a garage repair business called
‘Flintstones’, which they are looking to sell because they want to
relocate to larger premises. They have added a number of items to
their property including: (i) An engine hoist to lift the engines
out of cars they are working on; (ii) A multi-drawer tool kit fixed
to the shed wall with a single bolt for improved stability; (iii) A
refrigerator to keep their milk fresh for their tea breaks and
their lunches cool; (iv)a portable air-conditioner for the benefit
of themselves and any customers visiting their premises; and (v) an
external spotlight and timer to provide greater security and
protection at night.
(a) Explain the difference between a fixture and a chattel and
the tests employed to determine whether an item is a chattel or a
fixture.
Using those tests, which you have identified in (a), explain
whether each of the items listed above would be a fixture or a
chattel.
