ASSIGNMENT: Individual Writing Assignment 1

ASSIGNMENT DUE DATE: Sunday, October 21,
2018

ASSIGNMENT INSTRUCTIONS:

Students will be able to select from one of scenarios attached.
Imagine that the Director of your company, or a Partner at your law
firm has come to you with the scenario and requests that you write
a memo that he/she can use to further evaluate the problem before
going into a meeting. You don’t want to give him/her an
encyclopedia to read when he/she only has five (5) minutes to
digest your memo. If the Director/Partner wanted to read all of the
information, they would simply do the research themselves.

Therefore your job is to make the Director/Partner’s job easy by
preparing a memo outlining the specific of the scenario, as well as
providing answers to the specific questions asked for in the
scenario. This should be done in a memo fashion that allows the
reader to go directly to the points of interest. Your memo should
be similar to the following format providing:

Conclusion

I am not looking for a treatise or the greatest written legal
work that you can produce. While you must state the facts of the
scenario this should be a summary only! The area where students
lose points is for failure to follow the assignment directions as
to proper form and failing to label the important parts of the
brief.

Your research can be done online at the library, as well as by
utilizing materials that we have discussed in class. Students
should utilize at least three (3) separate resources and cite using
APA format.   

Students should make sure to provide citations as and where
necessary.

All assignments are to be submitted via blackboard in a
Microsoft Word format.

SCENARIO 1

The Frosty Cone, LLC is a popular ice cream shop that caters to
high school students in Howard County, Maryland. Mike, a full-time
employee, worked at The Frosty Cone under a standard employment
contract that called for Mike to be paid $10.00 per hour in
exchange for working 40 hours per week. This contract stayed in
place until Tim, the sole member of the LLC, terminated Mike’s
employment because sales had decreased due to the sluggish economy
and the opening of a new competitor, The Candy Shop three blocks
away. Although Mike had a contract and was The Frosty Cone’s
longest term employee, he was terminated during the economic
slowdown because customers had complained that he was rude and
angry all of the time. After Mike’s employment was terminated, his
best friend Ray continued to work part time at The Frosty Cone. Ray
was 15 years old and his job at The Frosty Cone was the first job
he ever had.

One afternoon in August 2018, Mike stopped by The Frosty Cone to
visit Ray. Tim was out for lunch at the time, so Mike went behind
the counter and assisted Ray in serving ice cream to the customers.
While he was working behind the counter, Mike’s former girlfriend,
Sue, came into The Frosty Cone and began making loudly critical
comments about Mike. Mike responded by throwing a container of
boiling fudge sauce at Sue. Sue was rushed to the hospital where
she was treated for second degree burns that required several
painful skin grafts over a period of six months. She has permanent
scars.

In October 2018, Sue files suit against Mike, Tim, Ray, and The
Frosty Cone, LLC for the injuries she sustained

Also, in October, 2018, Mike files a wrongful termination suit
against The Frosty Cone and Tim alleging breach of his employment
contract.

You work for the law firm, Dewey, Cheatem, and Howe and
are representing Sue in her lawsuits as well as Mike in his lawsuit
against The Frosty Cone. Draft a memo to the senior partner, Mr.
Koenig, analyzing the potential liability of each party under the
alleged claims.

SCENARIO 2

17 year old Karen Smith was in an automobile accident on
February 1, 2018. She was taken to the emergency room of General
Hospital in Prince Georges County, MD. Karen sustained various
injuries to her head and was unconscious when she arrived at the
hospital. Unable to find any identification and due to the severity
of her injuries, the attending physician, Steve “the cutter” Jones
treated Karen immediately even though there was no agreement
regarding payment. In his overzealous manner, Steve also took out
Karen’s appendix while performing exploratory surgery, even though
it appeared healthy, and accidently removed three toes on Karen’s
left foot. Several hours after she was admitted, Karen regained
consciousness; she remained in the hospital for three days. Karen
fully recovered from her injuries.

In March, 2018, the hospital billed Karen $75,000 for her
hospital stay, charging $35,000 for the head injuries, $30,000 for
the exploratory surgery and appendectomy, and $10,000 for the toe
amputation. In April, 2018 these bills remain unpaid. The hospital
file shows that previous attempts to collect this debt from Karen’s
parents have failed, and that Karen’s parents moved out of State
several months ago. Karen resides in the state of Maryland, holding
a job as an office receptionist. Due to the expense, Karen does not
currently and did not have health insurance at the time of the
accident.

You work for the law firm of Sharpe,
Knife & Slip who received this case last week, and is
representing the Hospital. Draft a memo to the senior partner, Mr.
Koenig, analyzing how the hospital may move forward and recover
this debt from Karen, what defenses Karen may raise, and what, if
any, other issues the Hospital may have to be aware of while
attempting to collect this debt.
