Jenny owns a printing business located in the city center and
usually takes the bus to and from her work. Last Friday she was
running late and decided to drive her car instead. She parked it in
a commercial car park close to her office. There is a sign on the
entrance to the car park listing the fees payable for parking and a
sign that reads: “Cars are parked at their owner’s sole risk.
Neither the operator ofthe car park nor its employees or agents
shall be liable for any loss, damage or injury to the vehicle, its
contents or any person howsoever that loss, damage or injury may be
caused.” The same wording is on the back ofthe ticket that Jenny
got from the automatic ticket machine as she drove into the car
park (which she put into her handbag without reading). During the
day, a fife broke out in the car park when someone carelessly
dropping a cigarette butt into a pile ofpapers that then ignited.
Jenny’s car was completely destroyed in the fire. It is a new model
BMW which she bought to impress her potential clients and will be
